AO PROCESSAMENTO E PAGAMENTO DO BENEF\u00cdCIO EMERGENCIAL DE PRESERVA\u00c7\u00c3O DE EMPREGO E RENDA (BEm) CRIADO PELA MP N\u00ba 936<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2a186b87 elementor-widget elementor-widget-text-editor\" data-id=\"2a186b87\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong>A Medida Provis\u00f3ria (MP) n\u00ba 936, que instituiu o Programa Emergencial de Manuten\u00e7\u00e3o do Emprego e da Renda, possibilitou a redu\u00e7\u00e3o proporcional da jornada de trabalho e do sal\u00e1rio e a suspens\u00e3o tempor\u00e1ria do contrato de trabalho durante o estado de calamidade p\u00fablica decorrente do covid-19.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Com o objetivo de preserva\u00e7\u00e3o do emprego e da renda e da garantia da continuidade das atividades laborais e empresariais, criou o Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda (BEm).<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Para o processamento e o pagamento do benef\u00edcio, no entanto, havia a necessidade de sua regulamenta\u00e7\u00e3o. Sendo assim, em 24 de abril de 2020, foi publicada a Portaria de n\u00ba 10.486 da Secretaria Especial de Previd\u00eancia e Trabalho do Minist\u00e9rio da Economia, cujos pontos principais ser\u00e3o abordados a seguir.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>QUEM TEM DIREITO AO BENEF\u00cdCIO?<\/strong><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Conforme previsto na Medida Provis\u00f3ria, ter\u00e1 direito ao benef\u00edcio o empregado que pactuar com o empregador a redu\u00e7\u00e3o proporcional ou a suspens\u00e3o tempor\u00e1ria do contrato de trabalho.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">O primeiro regramento que destaco \u00e9 o direito de recebimento do BEm independentemente do cumprimento de qualquer per\u00edodo aquisitivo, tempo de v\u00ednculo empregat\u00edcio e do n\u00famero de sal\u00e1rios recebidos, desde que esteja vinculado ao trabalho at\u00e9 o dia 1\u00ba de abril de 2020, data de entrada em vigor da MP n\u00ba 936.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Significa dizer que, ainda que o empegado possua menos de um m\u00eas de trabalho e n\u00e3o tenha nem mesmo recebido sal\u00e1rio, se houver o acordo de redu\u00e7\u00e3o proporcional ou suspens\u00e3o do contrato e se preenchidos os requisitos, ter\u00e1 direito ao benef\u00edcio.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Importante ressaltar, ainda, que somente ser\u00e3o considerados para fins de recebimento do BEm os contratos de trabalho iniciados at\u00e9 1\u00ba de abril de 2020 e informado no e-social at\u00e9 2 de abril de 2020.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>COMO SER\u00c1 CALCULADO O BENEF\u00cdCIO?<\/strong><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong>A base de c\u00e1lculo do benef\u00edcio \u00e9 o valor do seguro desemprego a que o empregado teria direito, sendo observadas as seguintes regras:<\/p>\n<p><\/p>\n<ol class=\"wp-block-list\" type=\"a\">\n<li>Deve-se considerar a m\u00e9dia salarial dos \u00faltimos 3 (tr\u00eas) meses anteriores \u00e0 celebra\u00e7\u00e3o do acordo\n<ol>\n<li>O sal\u00e1rio utilizado \u00e9 o que se refere ao sal\u00e1rio de contribui\u00e7\u00e3o, informados no Cadastro Nacional de Informa\u00e7\u00f5es Sociais \u2013 CNIS<\/li>\n<\/ol>\n<\/li>\n<li>Calculada a m\u00e9dia salarial, a base de c\u00e1lculo do benef\u00edcio ser\u00e1 encontrada aplicando-se as seguintes regras:\n<ol>\n<li>Para m\u00e9dia salarial com valor at\u00e9 R$ 1.599,61:\n<ol>\n<li>Multiplica-se a m\u00e9dia de sal\u00e1rios por 0,8<\/li>\n<\/ol>\n<ol>\n<li>Deve observar como valor m\u00ednimo o sal\u00e1rio m\u00ednimo<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li>Para m\u00e9dia salarial com valor de R$1.599,62 at\u00e9 R$ 2.666,29:\n<ol>\n<li>Multiplica-se a m\u00e9dia de sal\u00e1rios que exceder a R$ 1.599,61 por 0,5<\/li>\n<\/ol>\n<ol>\n<li>Soma-se o resultado ao valor de R$ 1.279,69<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li>Para m\u00e9dia salarial com valor superior a R$ 2.666,29:\n<ol>\n<li>\u00a0o valor base \u00e9 de R$ 1.813,03<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<li>Ap\u00f3s, encontrado o valor base, o BEm corresponder\u00e1 a:\n<ol>\n<li>100% do valor base, no caso de suspens\u00e3o do contrato de trabalho, se a empresa contar com faturamento de at\u00e9 R$ 4.800.000,00 (quatro milh\u00f5es e oitocentos mil reais)<\/li>\n<\/ol>\n<ol>\n<li>70% do valor base, no caso de:\n<ol>\n<li>suspens\u00e3o do contrato de trabalho de empregado de empregador com faturamento superior a R$ 4.800.000,00 (quatro milh\u00f5es e oitocentos mil reais)<\/li>\n<\/ol>\n<ol>\n<li>redu\u00e7\u00e3o proporcional de jornada e de sal\u00e1rio igual ou superior \u00e0 70%<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li>50% do valor base, no caso de redu\u00e7\u00e3o proporcional de jornada e de sal\u00e1rio igual ou superior \u00e0 50% e inferior \u00e0 70%<\/li>\n<\/ol>\n<ol>\n<li>25% do valor base, no caso de redu\u00e7\u00e3o proporcional de jornada e de sal\u00e1rio igual ou superior \u00e0 25% e inferior \u00e0 50%<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>ATEN\u00c7\u00c3O \u00c0S REGRAS SOBRE O PROCESSO ADMINISTRATIVO<\/strong><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Em rela\u00e7\u00e3o ao regramento sobre o processamento do benef\u00edcio, \u00e9 de suma import\u00e2ncia atentar-se \u00e0 obrigatoriedade de o empregador informar ao Minist\u00e9rio da Economia a realiza\u00e7\u00e3o do acordo, no prazo de 10 (dez) dias, a contar da sua celebra\u00e7\u00e3o, por\u00a0 meio do site <a href=\"https:\/\/servicos.mte.gov.br\/bem\" rel=\"nofollow noopener\" target=\"_blank\">https:\/\/servicos.mte.gov.br\/bem<\/a>.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Para os acordos feitos antes da entrada em vigor da portaria, o prazo de 10 (dez) dias ser\u00e1 contado da publica\u00e7\u00e3o desta.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">A n\u00e3o observ\u00e2ncia desse prazo sujeitar\u00e1 o empregador ao pagamento da remunera\u00e7\u00e3o no valor anterior \u00e0 redu\u00e7\u00e3o ou suspens\u00e3o, inclusive aos respectivos encargos sociais, at\u00e9 que a informa\u00e7\u00e3o seja efetivamente prestada.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>QUANDO E COMO O BENEF\u00cdCIO SER\u00c1 PAGO?<\/strong><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong>A primeira parcela do Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda (BEm) ser\u00e1 paga 30 (trinta) dias ap\u00f3s a data de in\u00edcio da redu\u00e7\u00e3o ou suspens\u00e3o, desde que comunicados pelo empregador no prazo de 10 (dez) dias.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Caso o empregador n\u00e3o observe o prazo para informar o Minist\u00e9rio da Economia, a primeira parcela ser\u00e1 paga no prazo de 30 (trinta) dias, a contar da data em de presta\u00e7\u00e3o efetiva da informa\u00e7\u00e3o.<\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 O benef\u00edcio poder\u00e1 ser creditado diretamente na conta banc\u00e1ria do empregado, desde que expressamente por ele e informado pelo empregador.<\/p>\n<p><\/p>\n<p
