A conjuntura dos fatores socioecon\u00f4micos que motivaram a edi\u00e7\u00e3o de diversos instrumentos normativos criou um microssistema jur\u00eddico, tempor\u00e1rio e excepcional, denominado regime jur\u00eddico de exce\u00e7\u00e3o.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">As medidas provis\u00f3rias at\u00e9 ent\u00e3o editadas para a regulamenta\u00e7\u00e3o dos contratos de trabalho durante o estado de calamidade p\u00fablica trouxeram, ao mesmo tempo, solu\u00e7\u00f5es pr\u00e1ticas e uma avalanche de d\u00favidas sobre o futuro das rela\u00e7\u00f5es trabalhistas.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Nesse contexto, com prud\u00eancia, \u00e9 necess\u00e1rio conferir legalidade e seguran\u00e7a aos atos jur\u00eddicos praticados no \u00e2mbito dessas rela\u00e7\u00f5es, com o objetivo de evitar a revers\u00e3o desses atos e o aumento do passivo trabalhista.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00c9 justamente com essa finalidade que a Reforma Trabalhista (Lei 13.467\/2017), rompendo com o antigo paradigma tradicional do processo trabalhista, instituiu o processo de jurisdi\u00e7\u00e3o para homologa\u00e7\u00e3o de acordo extrajudicial, com previs\u00e3o nos artigos 855-B a 855-E da CLT.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Com a cria\u00e7\u00e3o do novo instrumento, \u00e9 poss\u00edvel que empregado e empregador aju\u00edzem a\u00e7\u00e3o para homologa\u00e7\u00e3o de acordo celebrado diretamente por eles, sem que seja necess\u00e1ria a interven\u00e7\u00e3o pr\u00e9via do judici\u00e1rio.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>Benef\u00edcios da homologa\u00e7\u00e3o de acordo<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Desde a entrada em vigor do C\u00f3digo de Processo Civil de 2015 (CPC\/15), a valoriza\u00e7\u00e3o das formas alternativas de solu\u00e7\u00e3o dos conflitos se tornou ainda mais evidente.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Conforme o art. 3\u00ba do CPC, sempre que poss\u00edvel, o Estado dever\u00e1 promover a solu\u00e7\u00e3o consensual dos conflitos, os quais devem ser estimulados por ju\u00edzes, advogados, defensores p\u00fablicos e membros do Minist\u00e9rio P\u00fablico.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Mas o que faz as formas alternativas de solu\u00e7\u00e3o de conflitos se tornarem t\u00e3o relevantes a ponto de reestruturar parcela da din\u00e2mica processual?<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Em termos pr\u00e1ticos, esses instrumentos s\u00e3o utilizados em detrimento dos procedimentos contenciosos, no qual h\u00e1 conflito de interesses qualificado por uma pretens\u00e3o resistida.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u00c9 de conhecimento comum que um processo judicial poder\u00e1 levar meses at\u00e9 a prola\u00e7\u00e3o de uma senten\u00e7a \u2013 isso se n\u00e3o for interposto recurso \u2013 e at\u00e9 anos para que sejam totalmente satisfeitas algumas obriga\u00e7\u00f5es.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Em contrapartida, os procedimentos para homologa\u00e7\u00e3o de acordo costumam ser bem mais c\u00e9leres, considerando que os interessados apresentam ao judici\u00e1rio a solu\u00e7\u00e3o para os seus pr\u00f3prios problemas.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Al\u00e9m da economia de tempo, h\u00e1 tamb\u00e9m uma economia financeira, j\u00e1 que n\u00e3o h\u00e1 condena\u00e7\u00e3o em honor\u00e1rios nesse tipo de procedimento.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Por fim, o fato psicol\u00f3gico tamb\u00e9m corrobora com os benef\u00edcios, pois o estresse advindo de conflitos normalmente presentes nas reclama\u00e7\u00f5es trabalhistas \u00e9 praticamente nulo nos procedimentos para homologa\u00e7\u00e3o de acordo extrajudicial.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\"><strong>Requisitos e procedimento para a homologa\u00e7\u00e3o de acordo extrajudicial na Justi\u00e7a do Trabalho<\/strong><\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Conforme a previs\u00e3o do art. 855-B da CLT, o processo de homologa\u00e7\u00e3o do acordo extrajudicial ser\u00e1 iniciado por peti\u00e7\u00e3o conjunta.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">A peti\u00e7\u00e3o, dirigida ao ju\u00edzo competente, dever\u00e1 conter o acordo entabulado, com as especifica\u00e7\u00f5es dos termos do acordo, a qualifica\u00e7\u00e3o completa dos interessados, o pedido de homologa\u00e7\u00e3o, a data e assinatura dos advogados. Se preferir, poder\u00e1 a peti\u00e7\u00e3o se limitar \u00e0 indica\u00e7\u00e3o do instrumento de acordo, que dever\u00e1 ser juntado \u00e0 inicial.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">O acordo dever\u00e1 indicar e especificar, pormenorizadamente, as parcelas, os valores e os vencimentos, porquanto n\u00e3o h\u00e1 possibilidade de quita\u00e7\u00e3o gen\u00e9rica de todas as poss\u00edveis obriga\u00e7\u00f5es do contrato de trabalho.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Para a homologa\u00e7\u00e3o, \u00e9 obrigat\u00f3ria a presen\u00e7a de advogados diversos para cada interessado, tendo em vista a proibi\u00e7\u00e3o de representa\u00e7\u00e3o dos interessados por advogado comum. Caso queira, o empregado poder\u00e1 optar por ser assistido pelo advogado do sindicato da sua categoria.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Homologada a peti\u00e7\u00e3o inicial conjunta, o magistrado analisar\u00e1 a peti\u00e7\u00e3o em quinze dias, oportunidade em que examinar\u00e1 a sua regularidade, designar\u00e1 audi\u00eancia se entender necess\u00e1rio e
